Defective Information Results in Dismissal
The prosecution charged Mr. Rodriguez in a misdemeanor information with, inter alia, third-degree criminal possession of a forged instrument. He subsequently pled guilty. The Appellate Division reversed the judgment, vacated the plea, and dismissed the count because the information failed to include sufficient factual allegations regarding the officer’s conclusions.
