Risk Factor Points Successfully Challenged, Resulting in Level 1 Adjudication
The Board of Examiners of Sex Offenders assessed 95 points, including for risk factor 2 (sexual contact), risk factor 4 (duration of conduct), and risk factor 7 (relationship with complainant). Factors 2 and 4 were successfully challenged on the basis that there was no sexual contact by our client. Factor 7 was successfully challenged because the evidence did not establish the relationship was established for the purpose of victimization. Without these 45 points, our client was adjudicated a Level 1.
