SORA Hearing Court Grants Downward Departure to Level 1 Based on Client’s Rehabilitation

Our client committed the underlying non-contact sex offense when he was 22 years old. He had no prior or subsequent criminal record. During the nearly five years he was at liberty during the pendency of the case, he earned graduate degrees with honors and completed intensive outpatient treatment. Despite the prosecution’s Level 2 request, the court granted a downward departure to Level 1. The court noted the client’s rehabilitation, including that he recognized the root causes of his offense and that he gained the necessary tools through therapy to never repeat it.
