Incorrect Assessment of Points Results in Level 2 Adjudication

Our client was convicted of federal sex trafficking. The Board of Examiners of Sex Offenders and the prosecution each recommended he be adjudicated a Level 3. Contesting the assessment of points based on sexual contact, Appellate Advocates argued that there was no sexual contact by or with our client. The hearing court agreed and did not assess the points. The prosecution also sought an additional 45 points not scored by the Board. Appellate Advocates objected for lack of notice, and the hearing court agreed. Our client was adjudicated a Level 2.
