Downward Departure Granted to Level 1
The Board of Examiners of Sex Offenders recommended that our client, who recently moved to New York, be adjudicated a Level 2. The People also sought a Level 2 finding. Noting that our client had been at liberty for more than 20 years without re-offending, was steadily employed, and was in a stable relationship, we argued that a downward departure to Level 1 was appropriate. The Court agreed and granted the downward departure.
