SORA Hearing Court Rejects People’s Nolo Contendere Plea Argument, Client Adjudicated Level One
Approximately 15 years ago, our client was convicted by plea of nolo contendere in Florida. Upon moving to New York, the Board of Examiners of Sex Offenders recommended that he be adjudicated a Level One, the lowest level. Prior to the SORA hearing, the People sought to assess additional points that would increase him to a Level Two, based on the claim that a nolo contendere plea indicated a failure to accept responsibility. The hearing court agreed with our argument that such a plea does not justify the assessment of points for that category and adjudicated our client the lowest level.
