People Concede SORA Points Improper, Resulting in Level Reduction
At this Sex Offender Registration Act hearing, the Board of Examiners of Sex Offenders recommended the assessment of 20 points under risk factor 4, alleging our client engaged in a continuing course of sexual misconduct with the complainant. With the inclusion of those 20 points, our client scored as a level three. The assessment of the 20 points was challenged at the hearing, as the factor had not been established by clear and convincing evidence. The prosecution conceded the assessment and the court agreed, resulting in our client being adjudicated a level two.
