Conviction Reversed and Accusatory Instrument Dismissed
Mr. Bullock pled guilty to fourth-degree criminal possession of a weapon for possessing a gravity knife and was sentenced to a one-year conditional discharge. Subsequently, the Legislature repealed the portion of the statute banning simple possession of gravity knives. On appeal, we argued that the repeal was retroactive and should apply to defendants on direct appeal at the time of the enactment. The Appellate Term agreed and reversed the conviction and dismissed the accusatory instrument in the interest of justice.
