SORA Court Grants Downward Departure to Level One
As a teenager, our client was convicted of a sex crime he committed with two adult co-defendants. He was sentenced to a 25-year prison term. The Board of Examiners of Sex Offenders evaluated our client more harshly than his two co-defendants, based on the theory that sexual misconduct committed by a juvenile leads to a greater chance of sexually re-offending as an adult. Relying on recent research indicating that the opposite is true — teenagers convicted of sex offenses are less likely to re-offend — our office sought a downward departure. The court agreed and our client was adjudicated a level one.
