Sentencing Court Failed to Consider Youthful Offender Adjudication
The Criminal Procedure Law requires that there be a youthful offender determination in every case where the individual is eligible. The sentencing court failed to do so. The sentence was vacated and remitted for resentencing. Judgment Reversed & New Trial Ordered.
